Second phase of port tender processes
Representing Empresa Portuaria San Antonio, he obtained the authorizations required by the Antitrust Tribunal to bid for two new docking/mooring sides. During the first phase of the referred bidding (1998-2002), he represented Empresas Portuarias of Valparaíso, San Antonio, Talcahuano – San Vicente and Antofagasta.
Subcontracts labor rules
After new regulations on subcontracting were passed a precedent regarding the illegitimacy of the sanctions imposed by the Labor Department was obtained by our litigation team.
Class action
For material reasons and not formal – as has happened in other cases – the action filed against the largest bank of Chile was held inadmissible.
International arbitration
Based on the new Chilean International Commercial Arbitration Law, the first precautionary measure on assets located in Chile was obtained, in connection with an arbitration to take place before the ICC in Paris.
Luxury goods tax
Commissioned by the Ministry of the treasury and the National Customs Service, we obtained the revocation of a ruling issued by the Supreme Court that had previously declared illegal the tax imposed to luxury goods.
Antitrust fiscalization
For the first time, the Supreme Court revoked the content of a judicial award issued by an Antitrust Agency. Before this, only reductions in the fines were accepted by the Court.
